Customs Refusal and Item Not Received Disputes: Merchant Guide

Resumo:

  • A customs hold, a buyer refusal, a return and a destroyed parcel are four different states, and none of them proves delivery.
  • The checkout duty promise (DDP or DAP) and the label actually used decide who owed the import bill.
  • Visa treats goods held by the buyer's own customs agency as an invalid 13.1 dispute; PayPal US Seller Protection still needs proof of delivery.
  • US de minimis suspension and the EU €3 duty from July 1, 2026 put more low-value parcels at risk of refusal.

A customs refusal INR dispute starts when a buyer declines import charges and then files an Item Not Received (INR) claim. Your answer should show where the parcel is, what duty terms the buyer saw, and which payment rules apply.

A refusal is useful evidence. It is not proof of delivery, and it does not win the case on its own.

This guide covers:

  • How to tell a customs hold from a refusal, a return and a destroyed parcel.
  • How the 2025-2026 duty changes in the US and EU raise refusal risk on low-value orders.
  • How PayPal, Visa and Mastercard treat each shipment state.
  • An evidence checklist and a worked case timeline.

It builds on the cross-border ecommerce guide, which covers disputes across markets, and the cross-border payments pillar, which covers how money moves between countries.

Why Are Customs Refusals Rising in 2026?

More low-value parcels now owe import charges at the door. That gives buyers more chances to refuse.

In the US, CBP processed over 1.36 billion de minimis shipments in fiscal year 2024. Duty-free treatment for shipments of $800 or less was suspended for all countries on August 29, 2025. A CBP rule published June 24, 2026 made that suspension indefinite. The same rule notes that Congress ended the exemption by law from July 1, 2027.

In the EU, 4.6 billion e-commerce parcels under €150 arrived in 2024, according to the Council of the EU. From July 1, 2026, those parcels owe a flat €3 customs duty per item category, not per parcel. Sellers using the Import One-Stop Shop (IOSS) still collect VAT at checkout, but the new duty applies too.

What this means for you: a buyer who expected a duty-free delivery may now get a carrier bill. If your checkout did not show that cost, expect more refusals and more INR claims.

Is It a Customs Hold or a Customer Refusal?

Name the shipment state before you pick a defense. A tracking gap is not proof that the buyer refused to pay.

A carrier may be waiting for paperwork, assessing a charge, or trying to reach the buyer. Ask the carrier, in writing, for three things: the current location, the hold reason, and the next available action.

During clearance, the parcel may sit with the carrier, a broker or a customs agency. For the US side, see US Customs and Border Protection's missing-package guidance. Confirm who has the parcel before you call it a customs problem.

Shipment stateWhat it provesRecord to get next
Held by destination customsA current hold, if location and reason are confirmed. Not delivery, not refusal.Who holds it, why, the charge requested, release options.
Held by customs in your countryThe parcel never left your side of the border.Export or clearance notice and the fix you made.
Buyer refused import chargesA recorded buyer decision linked to the parcel.Carrier refusal scan, buyer message, checkout duty terms.
Returned to senderA return has started. Goods are not back in stock yet.Return tracking, warehouse receipt, item inspection.
Abandoned or destroyedA final outcome set by the carrier or authority.Disposition notice, who authorized it, any carrier claim.

If the carrier uses an unfamiliar event code, ask what it means and when the event happened. A support agent's guess is weaker than the carrier's written explanation. Keep both the scan history and the clarification.

Who Was Supposed to Pay the Import Charges?

Check the promise the buyer saw at checkout against the shipping service you actually used. Save the order page, the charges shown, the confirmation email and the shipping terms as they were on the order date. Today's policy page is not enough.

Shopify's shipping terms guide explains the two common setups:

  • Delivered Duty Paid (DDP): the seller takes on import costs, often collected at checkout.
  • Delivered at Place (DAP): the buyer pays the carrier's import charges on arrival. DAP replaced the older DDU (Delivered Duty Unpaid) term.

These terms explain who owed the bill. They do not override consumer rights or dispute rules.

If you promised a duty-paid price but the carrier still billed the buyer, look at your fulfillment setup first. Check the label terms, the billing account and the duty record. A third-party warehouse may have used a different service.

Shopify's international shipping considerations warn that duties collected at checkout need a matching DDP label workflow. A tax line at checkout alone does not prove the carrier got the instructions. Our guide to 3PL chargeback evidence handoffs covers which warehouse fields to request.

Your review should answer these questions:

  • Did checkout show import charges, or promise a duty-paid price?
  • Which shipping terms were on the label: DDP or DAP?
  • Did the carrier bill the buyer, and for how much?
  • Did the buyer refuse clearly, in writing or by carrier scan?
  • Where is the parcel now, and who controls it?

Stick to facts. "Customer responsible for duties" is a claim. Support it with the sale record.

How Do PayPal, Visa and Mastercard Treat a Customs Refusal?

Each payment route has its own rules. Record the provider, case number, allegation and deadline first. Then pick the defense.

RouteKey ruleWhat it means for a refusal
PayPal INR claim (US)Seller Protection needs proof of delivery to the transaction address.A refused parcel has no delivered scan. Submit the refusal and duty terms, but protection is not assured.
Visa 13.1Goods held by the cardholder's country's customs agency are listed as an invalid dispute.Prove the parcel is held at destination customs. Goods held in your country stay your risk.
Mastercard 4853 (legacy 4855)Goods or services not provided sits under the Cardholder Dispute chargeback.Send the refusal and disposition records, and ask your acquirer which second presentment fits.

PayPal Item Not Received Claim

For US accounts, PayPal's Seller Protection terms require proof of delivery for an eligible INR claim. The terms also exclude INR chargebacks a buyer files directly with their card issuer. A parcel held or refused at customs has no delivered scan at the transaction address.

You can still send the refusal record and sale terms. Just do not claim Seller Protection is guaranteed. Our PayPal Seller Protection guide covers US eligibility, and the PayPal item not received dispute guide covers the delivery proof PayPal usually wants.

PayPal's US Purchase Protection terms describe how PayPal reviews buyer eligibility. They also keep PayPal's process separate from a card-issuer dispute. Do not assume a forum post's "customs refusal exception" applies to your account market.

Visa 13.1 Merchandise or Services Not Received

Visa's public rules (24 October 2026 edition) split customs holds by location. Goods held by the cardholder's country's customs agency appear among invalid disputes under condition 13.1. Goods held in the merchant's country remain the merchant's responsibility. See section 11.11.2 and the invalid disputes table on pages 752–753.

So the parcel's actual location matters. Do not call a returned or destroyed parcel "held at customs." Ask your acquirer which response fits the facts and the case stage. The Visa reason code 13.1 guide covers the full workflow.

Mastercard Goods or Services Not Provided

Mastercard's Chargeback Guide, Merchant Edition (13 May 2025) places goods or services not provided under the Cardholder Dispute chargeback, message reason code 4853. Some processors still show the older 4855 code.

Do not assume Visa's customs wording applies to Mastercard. Send the refusal, duty terms and final parcel state, and ask your acquirer which second presentment condition fits. Check Mastercard chargeback time limits before the window closes.

Any Other Network or Provider

Find that provider's current rules and the actual case requirements. A shared label like "not received" does not mean the same protections or evidence standards.

What Evidence Wins a Customs Refusal Dispute?

Lead with a short dated chronology, then attach the exhibits. The reviewer should connect the order, the import bill, the buyer's action, the parcel outcome and any refund without reading a long inbox thread.

  1. Order record: transaction ID, order date, items, ship-to address.
  2. Duty disclosure: checkout screenshot or confirmation showing who pays import charges.
  3. Label terms: DDP or DAP, carrier service and billing account.
  4. Carrier charge notice: the import bill sent to the buyer, tied to the tracking number.
  5. Refusal proof: carrier refusal scan and any buyer message refusing to pay.
  6. Final state: hold, return or disposition notice, dated.
  7. Refund record: any refund or credit already issued.

Keep each exhibit tied to the parcel. A fee screenshot helps only if the reviewer can see which shipment it belongs to. A buyer email saying "I will not pay this" needs its full context, especially if the buyer says you already collected duties.

The chargeback evidence source map shows where each record lives across support, logistics and payments. For delivery proof that does exist, see how to use delivery confirmation to fight fraudulent chargebacks. Redact unrelated personal data, but keep the fields that identify the transaction and address.

Worked Case: Refused Duties, Then a Return to Sender

This is a hypothetical case, not a Chargeflow customer result. A merchant ships an order under disclosed buyer-paid import terms. The carrier bills the buyer, who declines. The carrier marks the parcel for return, and a payment dispute opens before the goods are back.

Dia 0
Shipment leaves
Save the order, the buyer-paid import notice and the label terms.
Day 6
Import bill refused
The carrier bills the buyer, who declines. Keep both records.
Day 9
Return begins
The carrier marks the parcel for return. The goods are not back yet.
Day 10
Dispute opens
Find the case route and deadline. Answer with the current parcel state.

Hypothetical timeline for illustration, not a carrier timetable or a predicted dispute result.

The response should say the parcel was refused and is being returned, backed by the carrier's record. It should not say the buyer got the goods, or that the merchant already has the stock back.

If the buyer says duties were prepaid, add the checkout receipt and the label billing check. If the parcel is destroyed instead, replace the return story with the disposition notice. Never keep an old "held at customs" line after the carrier confirms a new state.

Keep the refund decision open alongside the dispute. Consumer rights, your disclosed terms and the confirmed facts decide what you owe. Return freight does not automatically allow a deduction from a consumer refund.

What If the Carrier Returns or Destroys the Parcel?

Open a separate logistics check. Confirm who authorized the return, abandonment or destruction, which notices came first, and whether a carrier claim is possible. Ask for the disposition record instead of assuming the goods can be recovered.

Evri's international FAQ shows why this matters. When import charges are refused, Evri says it will try to return the parcel, but returns from customs are not guaranteed. Local authorities may hold or dispose of goods. That is one carrier's process, not a universal rule.

Track parcel value, outbound freight, return costs, fees, customer credits and any recovery as separate lines. An expected carrier payout is not cash yet. If the parcel was damaged or lost on the way back, our comparison of package protection vs. chargeback coverage explains which tool pays for what.

If you already refunded the buyer, attach that record to the case. Check your double-refund controls before you send another credit during an open dispute. Our guide to chargebacks vs. refunds explains when a refund is the cheaper path.

When a returned box arrives empty or with the wrong item, the evidence changes. See empty-box chargeback packing evidence for inspection steps.

How to Prevent the Next Customs Refusal Dispute

Fix the failure the evidence points to:

Root causeFix
Import cost not shown at checkoutShow landed cost or a clear "duties due on delivery" notice.
DDP promised, DAP shippedMatch checkout duty collection to the label terms and carrier account.
Missing customs dataFix product descriptions, origin and tariff codes.
Buyer refused a clearly shown chargeHandle as a support and refund decision, and keep the record.

Before you accept an order to a new market, check four things: service availability, accurate product and origin data, a working buyer contact channel, and a clear landed-cost message. Test whether support can pull refusal and return records before a dispute deadline.

Screening every cross-border order hard can also cost you good buyers. Our guide on how to prevent chargebacks without blocking good customers covers a lighter approach. Some buyers who claim non-delivery are not honest, so learn the patterns in scammers claiming an order was not delivered.

Pre-dispute tools can also help. Chargeback alerts let you refund a card dispute before it becomes a chargeback, which can make sense when the parcel is clearly lost.

When to Automate Customs Refusal Disputes

For a few cases a month, one owner and a shared chronology may be enough. When evidence spans stores, carriers and processors, Chargeflow Automation collects the records, builds the response and submits it. You pay only when a chargeback is recovered. It does not clear customs, set import taxes or guarantee the issuer's decision.

Customs Refusal and INR FAQs

What happens if a buyer refuses to pay customs charges?

When a buyer refuses customs charges, the parcel may be held, sent back, or left to local authorities who can dispose of it. The result depends on the carrier and the destination country. Get the carrier's written disposition record before you answer any dispute about the order.

Can a buyer file an item not received dispute after refusing customs?

Yes. A buyer who refused customs charges can still open an item not received (INR) dispute, because the parcel was never delivered. Your response depends on the payment route, the duty terms shown at checkout, and where the parcel is now. A refusal record helps, but it does not guarantee a win.

Is a package held at customs considered delivered?

No. A package held at customs is not delivered. It shows a stage in the journey, not receipt by the buyer. PayPal's US Seller Protection, for example, needs proof of delivery for an INR claim. Keep the hold record, and update your evidence if the parcel is later released, returned or destroyed.

Who pays customs duties, the buyer or the seller?

It depends on the shipping terms. Under Delivered Duty Paid (DDP), the seller pays import costs, often collected at checkout. Under Delivered at Place (DAP), the buyer pays the carrier on arrival. Your checkout and order confirmation should show which terms applied to that order.

Does Visa protect merchants when customs holds a parcel?

Visa's public rules treat merchandise held by the cardholder's country's customs agency as an invalid reason for a 13.1 dispute. Goods held by customs in the merchant's country stay the merchant's responsibility. Prove where the parcel is held, and confirm the available response with your acquirer.

Should I refund a buyer who refused import charges?

Decide based on your disclosed terms, the buyer's consumer rights, and whether the goods came back. If you refund, record it and attach the refund to any open dispute, so the buyer is not paid twice. Return freight does not automatically justify a deduction from a consumer refund.

Sources reviewed November 3, 2026. PayPal examples use US terms. The Visa customs rule is checked against its 24 October 2026 public rules. The worked timeline is hypothetical, and no case outcome is promised.
