Resumo:

  • Terms shown at purchase are one record in a dispute file, while the response itself must address the actual claim, such as nonreceipt, description, authorization or cancellation.
  • A merchant's refusal to refund does not by itself make a dispute valid or invalid.
  • Consumer rights depend on location and product, for example the EU 14-day withdrawal right and California's disclosure rule for specified retail policies.
  • Keep the dated policy version, the acceptance event, fulfillment records and the support and remedy history, joined to the disputed order.
  • Submit through the provider's workflow by the case-specific due date, not a universal deadline.

A no-refund policy is a merchant's stated rule that no refund will be issued on completed purchases, so the charge is treated as non-refundable. It sets the merchant's refund terms but does not decide every chargeback or override applicable consumer rights. A dispute response still needs the actual complaint, the terms shown at purchase, and records of the transaction.

Merchants often adopt strict no-refund terms to protect margin and cut down on abuse. This guide covers how no refund policy chargebacks work in practice: what a no-refund policy can and cannot establish, where its scope is limited by law and by the actual complaint, and what to document and use instead if the real goal is fewer disputes and better evidenced responses.

A no-refund policy is a statement, usually posted at checkout, on receipts, or in a website footer, that a business will not return money for completed purchases. It differs from a return policy, which governs whether a physical item can be sent back at all, and it differs from a chargeback, which is a dispute initiated by the cardholder with the card issuer rather than a refund issued by the merchant. A chargeback on a no refund policy purchase is still reviewed on its claim and records. A line such as "no refund will be issued" or "non-refundable" describes the merchant's terms; it does not by itself settle a dispute, and neither does a "no chargeback" clause in merchant terms.

  • Final sale: the merchant states that the item cannot be returned or refunded, commonly for clearance, custom, or perishable goods. Whether that term can be applied depends on the law and the product where the buyer is, as covered below.

Understanding the difference between a chargeback and a refund matters here: a refund is something the merchant controls, while a chargeback is a claim the cardholder brings through the card issuer. For a side-by-side view of how the two routes differ, see chargeback vs refund.

A no-refund policy does not remove a cardholder's ability to file a dispute. The merchant's own terms are one input; the claim the cardholder actually makes, and the card network and provider process it follows, determine what happens next. Several common dispute claims turn on facts that a refund policy does not address:

  • O titular do cartão alega que a transação não foi autorizada.
  • The item or service was never received.
  • The item or service was materially not as described, or was defective or damaged.
  • The cardholder asked the merchant for a refund, was refused, and took the complaint to their bank instead.

In that last case, the refusal is the background to the dispute, not the answer to it. The dispute is still reviewed against the actual claim, the terms shown at purchase and the transaction records. Some disputes are filed by cardholders who received what they ordered, which is often called friendly fraud; a claim alone does not show intent, so the response should rest on the records rather than on assumptions about the customer.

What the Policy Record Can and Cannot Establish

The policy is evidence of what the merchant stated, not proof of how the transaction went. Each record below supports a different part of a response, and each leaves something open. Where these records are gathered and joined to the order, the chargeback evidence sources guide shows which systems typically hold them.

Record What it supports What it does not settle Implementation action
Terms shown at purchase Which stated conditions were presented Whether every condition is enforceable in each market Retain the dated version and applicable product scope
Acceptance event Customer interaction with those terms Delivery, authorization or accurate description Join acceptance to the disputed order
Fulfillment and listing facts Whether the particular service or item was supplied as described All consumer remedy rights Preserve actual item or service records
Complaint and completed remedy What failed and what credit or replacement occurred A guarantee that no dispute can be filed Track the support, remedy and payment references

Illustrative case, not a real order: a final-sale item was never delivered. A checkout acceptance record establishes which terms the shopper saw, but it does not prove delivery. The response should address the nonreceipt facts and the applicable remedy rather than submitting only the policy screenshot.

Process matters too. On Stripe, for example, the case-specific due date controls the merchant response, submission is final once sent, and Stripe forwards the evidence while the issuer decides (Stripe: responding to disputes). Other providers have their own routes and deadlines, so check the case itself.

Beyond the dispute itself, a no-refund policy has legal limits that depend on where the buyer is and what was sold. They are not universal rules, and each one has exceptions.

California: disclosure of specified refund policies

California requires conspicuous disclosure when a retailer's policy limits full refunds or exchanges within at least seven days with a receipt, subject to exceptions. Where the required disclosure is missing in the stated circumstances, the remedy can include a 30-day return right. This is a California retail disclosure rule, not a universal US cooling-off period; see the California Attorney General guidance on refund policy disclosure. Other states have their own rules, so confirm the rule for the buyer's state rather than assuming the California rule applies.

European Union and United Kingdom: distance purchases

EU distance purchases generally carry a 14-day withdrawal right, with exceptions such as certain date-specific leisure tickets, personalized or perishable goods, and qualifying digital content where required consent and acknowledgment were given. Those exceptions do not remove every right concerning defects or failed performance (EU rules on returns and withdrawal). In the UK, customers of covered distance goods generally have 14 days to notify cancellation and a further 14 days to return the goods, and refunds generally follow within 14 days of receiving the return, with rules on delivery costs, exceptions and defective goods that differ from one another (UK government guidance on accepting returns and giving refunds). A no-refund line in terms does not displace these rights where they apply.

Dispute volume and monitoring programs

Separately from any single case, card networks and acquirers watch dispute ratios, and merchants should know where their own ratio stands. Merchants can review the current Visa and Mastercard chargeback thresholds and confirm the program rules that apply to their own acquirer.

No-Refund Policy vs. Flexible Refund Policy: What Each Gives You to Document

The table below compares what each approach leaves in the transaction record once a customer is dissatisfied. It describes documentation, not a guaranteed change in dispute volume.

Customer's route when dissatisfied No merchant refund path; the customer may use the support channel or go to the card issuer A refund or exchange path exists with the merchant first
Remedy record available Support history and any credit or replacement actually offered Refund, exchange or resolution offer can be documented with references
Disclosure scope Depends on applicable law and product; confirm for each market Standard return terms still need clear disclosure at purchase
What the terms settle in a dispute The merchant's stated terms only; not delivery, description or authorization The same limit applies; terms are one record among several

Melhores alternativas à política de não reembolso

Merchants who want to protect margin while keeping a clear resolution path generally do better with a policy that is strict but not absolute:

  • Ofereça crédito na loja ou uma troca, em vez de uma recusa categórica, para que ainda haja uma forma de resolver a situação que não exija o uso do Disputa.
  • Estabeleça um prazo definido para devoluções e requisitos específicos, em vez de uma regra rígida de “não aceitação de devoluções”.
  • Reserve final-sale terms for a narrow set of categories, such as personalized, perishable, or clearance items, and confirm they are permitted where the buyer is.
  • Disclose the policy clearly at checkout, on the product page, and on the receipt, not just buried in a terms page, and keep a dated copy of each version.
  • Respond to refund requests quickly, so customers are not left without a resolution path.

Chargeflow has a full walkthrough of how to write an ecommerce return policy from scratch, and a separate guide covering five ways to improve your return policy if one is already in place but still generating disputes. Shopify merchants can start from Chargeflow's Shopify refund policy template and the guide to a Shopify return policy rather than building one from a blank page. Sellers on creator marketplaces like Whop face a similar tradeoff; see how a clear policy supports work on Whop chargebacks.

One point to plan for either way: a refund process does not rule out disputes. Chargeflow's guide on getting a chargeback after issuing a refund covers what to do when a customer disputes a transaction that was already refunded.

This guide is written for merchants, but shoppers ask too: if a business posts a strict no-refund policy, is there any way to get money back, or how to get around a no refund policy?

Sometimes. Depending on the place and the product, disclosure rules or withdrawal rights may apply despite the posted terms, as in the California, EU and UK examples above. If a purchase was never delivered, was not as described, or was billed incorrectly, you can explain that problem to your card issuer or payment provider and use their dispute route; the claim and the records matter, not just the refusal. A dispute is not a substitute for reading the return terms before buying, and a change of mind alone is a weaker basis than a nonreceipt or description problem. It helps to contact the merchant first and keep the order confirmation, the terms shown at purchase and your messages.

Perguntas frequentes

Does a no-refund policy prevent chargebacks?

No. For any chargeback no refund policy question, the answer turns on the claim and the records. It can be part of the transaction record, but it does not remove all dispute rights or rebut every allegation. Preserve the purchase-time terms and claim-specific evidence.

Can you dispute a charge if a merchant refuses a refund?

A refusal does not by itself determine whether a dispute is valid. Explain the actual problem and use the applicable bank or provider route; the payment facts, terms and relevant rights matter.

Can you dispute a non refundable charge?

Possibly, so a shopper asking "can I dispute a non refundable charge" should look at the claim first. A non-refundable label describes the merchant's terms, but the dispute turns on the actual claim, such as nonreceipt, a description problem, authorization or a cancellation right, and on the records for it. The bank or provider route and its deadline apply.

It depends on the buyer's location and the product. Some places require specified policies to be clearly disclosed, for example California for specified retail policies, and EU and UK distance purchases carry withdrawal rights with exceptions. Check the rule for the market you sell into.

A defined return window, clearly disclosed conditions, and options like store credit or exchange give customers a resolution path without a blanket refusal. Reserve strict final-sale terms for a narrow set of product categories and confirm they are permitted where the buyer is.

Not on its own. A response is built from the actual claim and the transaction records. The policy shows which terms were presented, so pair it with acceptance, fulfillment and remedy records rather than relying on it alone.

A no-refund policy is not the shortcut it appears to be. It states the merchant's terms, but it does not override applicable consumer rights, and it does not answer a nonreceipt, description or authorization claim. Keep the dated terms, the acceptance record, the fulfillment facts and the complaint and remedy history together for each order.

The stronger position is a policy that is deliberately narrow rather than absolute, disclosed clearly at every touchpoint, and backed by a fast response process.
